Privacy Policy

Introduction

At CODECISION LIMITED ("we", "us", "our"), the data controller, we are committed to protecting your privacy, especially regarding the data collected on our promotional website for OmgFun at https://omgfun.com/ (the "Website").

This Privacy Policy explains how we collect, use, disclose, and safeguard your personal data when you visit our Website and interact with us, primarily through submitting your email address to receive product release notifications. By using the Website or providing your personal data, you acknowledge that you have read and understood this Policy.

1. Data Controller

The data controller responsible for your personal data is:

2. Personal Data We Collect

Given the nature of the promotional Website, the data collected is minimal and primarily related to providing launch updates.

Information You Provide Directly:

• Contact Information: Specifically, your email address (submitted to receive news and release notifications for the OmgFun product).
• Any information you provide in correspondence when you contact us directly via email.

Information We Collect Automatically:

• Technical Data: Your IP address, browser type, operating system, and platform.
• Usage Data: Information about your visit, including the pages you view, how long you spend on the Website, and how you arrived at the Website.
• Information collected through strictly necessary cookies (as described in Section 9).

3. How We Use Your Personal Data

We process your personal data for the following specific purposes related to the OmgFun product launch:

4. Legal Basis for Processing (EEA Users)

We rely on the following legal grounds to process your personal data:

• Consent: We rely on your explicit consent when you submit your email address via the form on the Website for the specific purpose of receiving product release communications. You may withdraw your consent at any time by clicking the unsubscribe link in the communication or by emailing [email protected].
• Legitimate Interests: Processing necessary for our legitimate business interests, such as maintaining the security and functionality of the Website and managing internal communications.
• Legal Obligation: Where we need to comply with legal or regulatory obligations.

5. Data Sharing and Disclosure

We may share your personal data only as necessary and with appropriate safeguards:

• Service Providers: Third-party companies that provide services on our behalf, such as website hosting, IT security, and email delivery services (for sending the launch notifications). These providers are bound by confidentiality and processing agreements.
• Advertising Platforms: Where you have accepted advertising cookies, we share the click identifier of the campaign you arrived from, and the fact that it led to an action on our side (for example a completed registration), with the advertising platform that referred you, so that the result of that campaign can be measured. Nothing is shared for this purpose unless you have accepted it (see Section 9).
• Business Transfers: In connection with any merger, sale of company assets, or acquisition.
• Legal Requirements: When required to comply with legal obligations, court orders, or to protect our rights or the safety of others.

We do not sell, rent, or otherwise disclose your personal data to third parties for their independent marketing purposes.

6. International Data Transfers

Your personal data may be transferred to and processed in countries outside the European Economic Area (EEA). When we transfer personal data outside the EEA, we ensure appropriate safeguards are in place, such as:

• Standard Contractual Clauses approved by the European Commission.
• Adherence to adequacy decisions by the European Commission.

7. Data Retention

We retain your personal data only for as long as necessary to fulfill the specific purposes for which it was collected, which, in this context, is primarily until the official release of OmgFun and a reasonable period thereafter, or until you withdraw your consent.

We will delete or anonymize your data when it is no longer required for legal, accounting, or business needs.

8. Your Privacy Rights (GDPR)

Depending on your location, you may have the following rights regarding your personal data. To exercise any of these rights, please contact us at [email protected]:

• Access: Request access to your personal data.
• Rectification: Request correction of inaccurate data.
• Erasure (Right to be Forgotten): Request deletion of your personal data, particularly after the OmgFun launch or if you withdraw consent.
• Restriction: Request the restriction of processing.
• Data Portability: Receive your personal data in a structured, machine-readable format.
• Objection: Object to processing based on legitimate interests.
• Withdraw Consent: Withdraw your consent at any time (as per Section 4).
• Lodge a Complaint: Lodge a complaint with a supervisory authority.

9. Cookies and Similar Technologies

We use cookies and similar technologies to ensure the basic functionality of the promotional Website, and — only with your consent — to measure the results of our advertising.

• Strictly Necessary Cookies: We use only strictly necessary cookies that are essential for the Website to function properly (e.g., session management). Since these are strictly essential for usability, they are based on our legitimate interest and do not require prior consent under GDPR. Disabling them may prevent the Website from working correctly.
• Consent Record: When you answer the cookie banner, your choice is stored on your device so that we do not ask again on every visit.
• Advertising and Measurement: If you arrive from an advertising campaign, the campaign's click identifier is held in memory for that page view only. It is stored on your device and shared with the advertising platform that referred you — so that the platform can measure the result of its campaign — only after you accept advertising cookies in the banner. If you decline, or while you have not answered, nothing is stored for this purpose and nothing is shared. We do not use third-party analytics cookies on this Website.
• Changing or Withdrawing Your Consent: You can review or change your choice at any time via Cookie Settings in the footer of this Website. A withdrawal takes effect going forward: from that moment we stop storing and sharing advertising data, and the data collected and shared while your consent was in force is not retroactively deleted.
• Managing Cookies: You can configure your browser to refuse cookies, but note that disabling the session cookie will affect the Website's functionality.

10. Data Security

We implement appropriate technical and organizational measures to protect your personal data, including data encryption, access controls, and regular security updates. However, we cannot guarantee the absolute security of data transmitted over the Internet.

11. Children's Privacy

Our Website is not intended for individuals under the age of 18. We do not knowingly collect personal data from children.

12. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify you of any material changes by posting the updated Policy on the Website and updating the "Last Updated" date. We encourage you to review this Policy periodically.
